The primary function of BOCW act registration is to resolve issues of unskilled labourers who work in concentrated deplorable conditions. The Government of India introduced the Building and Other Construction Workers (BOCW) Act in 1996.

Overview of BOCW Act Registration

To resolve issues of unskilled laborers who work in concentrated deplorable conditions, the Government of India introduced the Building and Other Construction Workers (BOCW) Act in 1996. This Act is also known as the BOCW Act of 1996. The primary intention of BOCW act registration is to keep a check on the workers’ working conditions. It can be considered a social welfare scheme that has a motive to provide assistance to the workers engaged in the activities of construction and building in India. BOCW Act’s preamble explains the following:

“This Act regulates the conditions of service and employment of building and other construction workers and to provide them safety, welfare and health measures and for other matters identical thereto that netted there

 in addition to that zone of BOCW Act registration is extensive and it covers framework other relevant labour laws, but particularly it relates to the Factories Act of 1948 the most.

Purpose of BOCW Act Registration

·         Safe and Healthy Working Condition

The BOCW Act registration ensures that the workers are not being exploited and have a safe and healthy working environment. It is every worker’s right to have a safe and healthy working environment and are not being deprived of basic necessities.

·         Workers Welfare Boards

The Government of India has made it mandatory for every State Government to comprise their Building and Other Construction Workers Welfare Boards. The state governments have to constitute these workers’ welfare boards so that the workers’ problems are solved as soon as possible, and the government can keep a close eye on the working conditions of the workers.

·         Provide Support to Workers

It is the responsibility of BOCW is to provide quick aid to the workers if there is any accident or mishap, issuing loans construction of the house, providing pensions after retirement, making payments regarding premia for group insurance scheme, supporting workers by providing financial support for medical expenses in case of major ailment and offer finance for the education of children. 

·         BOCW Welfare Fund

Every building or other construction worker who is between the age of 18 to 60 years and who has been involved in any building or other development work for at least 90 days during the preceding year is eligible for registration as a beneficiary of the Building and Other Construction Workers (BOCW) Welfare Fund under the BOCW Act. Workers can apply for BOCW act registration under the prescribed form with the necessary documents and INR 50 as a registration fee.

Documents Required for BOCW Act Registration

The list of documents detail is not very lengthy. Building and Other Construction Workers (BOCW) requires only basic documents for the registration process. Following is the list of documents and details:

  • Proof of Age, in case, if there is no age proof is obtainable than self-declaration will be submitted.
  • Residence Proof
  • Aadhar Card
  • Bank Account details such as account number, IFSC or RTGS number, and Bank Branch.
  • Information on dependents and working certificate from the employer, which notifies that the applicant has worked 90 days as a construction worker and the nomination form.

BOCW Act Registration Procedure

  • The first step is to log on to the website ims.mahaonline.gov.in
  • Now, the applicant has to choose the registration procedure, whether as an organization or as an individual.
  • The applicant has to provide his/her mobile number on which the OTP will be sent.
  • Fill the OTP received on the provided mobile number.
  • The applicant has to mention his/her E-mail address during the registration process.
  • Now, the applicant has to fill all the necessary fields that are being asked.
  • The applicant will receive an e-mail on the provided E-mail address. In the received e-mail, there will be some instructions for the applicant that must be followed.
  • Now, the applicant has to log into the website by mentioning the e-mail address and password.
  • The applicant will choose the service for building and other construction registration.
  • The applicant will decide on Establishment Principal Employer Registration and fill the form online and submit.
  • After the applicant has received an application ID, the application screen will not be available.
  • The applicant has to check the application’s status and has to go through the instructions mentioned on the right-hand side of the screen.
  • If the application status shows ‘upload documents,’ then the applicant has to click on ‘upload document.’
  • After the applicant has uploaded the documents, the application status will change and ask the applicant to make payment.
  • Now, the applicant has to make payment by clicking on the ‘Pay fee.” The applicant can choose the mode of payment.
  • The applicant will check the application status; if the status shows ‘under scrutiny,’ it means that the BOCW act registration application is ready for scrutiny.
  • In case if the registration application gets rejected, the applicant has to check his/her e-mail for further instructions.
  • If the registration status appears completed, the applicant has to download the registration certificate by clicking on the ‘Download Certificate.’

The government of India has done appreciable work towards the welfare of neglected building and other construction workers. It is realized that Government of India is furthermore intending to make amendments to the Building and Other Construction Workers (BOCW) Act to enhance the extent of applicability of the Act to empower the separate state government to execute the acts and it is hoped that the corrections will do good to the construction workers by giving better and more safe and sound working conditions.

This Act regulates the conditions of service and employment of building and other construction workers and provides them safety, welfare and health measures, and identical thereto or connected therewith. To resolve issues of unskilled laborers who work in concentrated deplorable conditions, the Government of India introduced the Building and Other Construction Workers (BOCW) Act in 1996. This Act is also known as the BOCW Act of 1996.
